Note for GEORGE JONES
The Devon Record Office has an”Inland Revenue” will of George Jones of Ottery St. Mary dated 1824, Reference 1078/IRW/J/263 which mentions his wife, and his children, George, John, William, Ann Holman and Martha Hopkins. All are named as Executors however the sworn Executor was his son John Jones of Thorverton in Devon, Butcher.
Since the will is a copy, I have only included the transcription (bj)
“This is the last will and Testament of me George Jones of Ottery Saint Mary in the County of Devon heretofore a Butcher which I make in manner following, that is to say, I give and bequeath unto my dear wife Jenny Jones One clear annuity or yearly sum of four Pounds of said fine british money for and during her natural life. To be paid to her by two equal portions in each season that is to say Christmas day and midsummer day & the portion thereof to be paid on such of the said days as shall next happen after my death. Also I give and bequeath to my said wife the use of my green curtain bed & bedding thereon and such articles of my other kind of Household Furniture as she shall make choice of not exceeding one article of sorts for and during her life and after her death the same to be considered as part of my residuary effects & go to my residuary legatees and I also give to my said wife all my Rights in the all such leaseholds previded? as belonged to her before our marriage and I do declare that what I have given to my said wife is in addition to the Fifty Pounds which she will be entitled to under our marriage settlement and is to be taken in lieu & instead of any Dower? thirds which she may have or claim in to or out of my hands & my Chattels and I do direct that my said wife shall sign an acknowledgment of the receipt of such household goods as she shall take for her use under the bequest aforesaid. Also I give and bequeath unto the Revd. John N?ocindall? & Mr. William Norrington both of Ottery Saint Mary aforesaid, the sum of Twenty Pounds of .........? British money in trust for my two Gransons, the sons of my late son Thomas to be equally divided between them respectively at their respective ages of twenty one years and if either of them shall die under that age then the share of him so dying shall go and be paid to the survivor of them his heirs, Administrators or Assigns, Provided and I do authorise the said Trustees to advance and pay out all or any part of the portions to my said Gransons respectively during their respective .........?ties as they shall think necessary for or towards their respective maintenance or getting them taught & instructed in any trade, art or profession. Also I give, devise and bequeath all my Close and land called Parkfield in Ottery Saint Mary aforesaid with its appurtenances and also all the Rent Revenue and remainder of my money and securities for money and all lands and premises which are mortgaged to me and all other my Goods, Chattels, Rights, Credits, Testamentary Estate & Effects whatever unto me three sons, George Jones, John Jones and William Jones and their respective Heirs, Executors, Administrators & Assigns for all my estate & interest therein respectively to be taken and divided between them in such proportions & for such purposes as hereinafterward is mentioned, that is to say, One fifth part thereof to be taken by my son George, his Heirs, Executors, Administrators & Assigns for his and their own use & benefit as Tenants in common. One other fifth part thereof to be taken by my son John Jones, his Heirs, Executors, Administrators & Assigns for his and their own use and benefit as Tenants in common. One other fifth part thereof to be taken by my son William Jones, his Heirs, Executors, Administrators & Assigns for his and their own use & benefit. One other fifth part thereof to be taken by my son John Jones, his Heirs, Executors, Administrators & Assigns as Tenants in common But nevertheless upon trust for my daughter Ann Holman to and for her separate use apart from her present or any after taken husband so that the same & every part thereof & the Rents, Shares & profits thereof shall be paid, used, applied, sold & disposed of in such manner & for such purposes as the said Ann Holman whether married or sole shall direct, order or appoint either in her lifetime or by her last will & Testament in writing which she is hereby authorised to make not withstanding her Ar?erture? and as to all such parts of the said Trust provided which shall not be disposed of by the said Ann Holman in her lifetime or be not by her ordered, directed or appointed to be disposed of after her death, the same shall be in trust for the Heirs, Executors & Administrators of the said Ann Holman respectively. and as to the remaining one fifth part of the same is to be taken by the said son John Jones, his Heirs, Executors, Administrators & Assigns as Tenants in common But nevertheless upon trust for my daughter Martha Hopkins to and for her sole & separate use apart from her present or any after taken husband so that the same & every part thereof & the Rents, Shares & profits thereof shall be paid, used, applied, sold & disposed of in such manner & for such purposes as the said Ann Holman whether married or sole shall direct, order or appoint either in her lifetime or by her last will & Testament in writing which she is hereby authorised to make not withstanding her Ar?erture? and as to all such parts of the remainder which the said Martha Hopkins shall not dispose of in her lifetime or be not by her ordered, directed or appointed how the same shall be disposed of after her death, the same shall be held in trust for the Heirs, Executors & Administrators of the said Martha Hopkins respectively. Provided and I do hereby charge all? my Land and residuary effects to and with the payment of my just Debts, Funeral expenses, legacies hereby given And I do appoint my said five children George, John, William, Ann & Martha, Executors of this my will. And I do hereby annul & make void all former Wills & Testamentary Dispositions by me made declaring this the only to be my last Will & Testament. In Witness whereof I have hereto set my hand & seal the Twentyfourth day of July 1824.”
